Commodity Dealer and Warehouse Licensing

The Montana Agricultural Warehouse Commodity Dealer and Grain Standards Act 80-4-402(4), MCA requires people or businesses who buy or store commodities to be licensed to protect farmers from financial loss resulting from non-payment for agricultural commodities. This law does not apply to dealer-to-dealer transactions. Separate licenses are required for commodity dealers and commodity warehouse operators.

Commodity Dealer
A commodity dealer is anyone who engages in a business that includes in buying, exchanging, negotiating, or soliciting the sale or transfer of agricultural commodities. A commodity dealer is required to be bonded as well as licensed. Exceptions to licensing are described in the 80-4-402(4), MCA. Commodity dealers also are required to file monthly grain movement reports to the department, which identify grain shipped, stored and received. Reports are due 20 days after the close of each month.

Commodity Warehouse
A commodity warehouse is an "elevator, mill warehouse, sub terminal grain warehouse, public warehouse, or other structure or facility in which, for compensation, agricultural commodities are received for storage, handling, processing, or shipment." Facilities that maintain a United States Warehouse Act license need not apply for the state's license. A public warehouse operator must post storage and handling charges for the facility. Operators must maintain current records of all agricultural commodities stored, conditioned, handled, or shipped.

Licenses for commodity dealers and commodity warehouses run from July 1 to June 30. Before the renewal date, renewal packets will be sent to current licensees. Applicant must submit the necessary information before the department will issue a new license.

License application renewals received after June 30 are assessed a $50 late fee.
